Wafi, Inc. (“Wafi”) is dedicated to protecting user privacy. This Privacy Policy describes how Wafi, Inc. and our affiliates (collectively, “Wafi,” “we,” and “us”) collect, use, disclose, transfer, store, retain or otherwise process your information when you (whether you are a business or person) access or use in any manner any Wafi solutions (including, Pay, Connect, Checkout, Invoice, Float Me, Pay with Wafi, Pay Now, Peer to Peer Payment and more) through Wafi’s website, API, web and mobile applications (collectively, “Services”); or otherwise contact or interact with us, even if you have not applied or signed up for a Wafi account or other Service or downloaded any of our applications.

This Privacy Policy applies to your use of our Services, and covers information collected in connection with your access to and use of our Services. Please read this Privacy Policy carefully. By continuing to interact with our Services, you are consenting to the practices described in this Privacy Policy.

We may, at any time, update this Privacy Policy by posting an updated version on our website or communicating it to you through our Services. Information we collect:

  • Personal Identification information: Such as full name, postal address, phone number, email address, account name, tax ID, date of birth or other similar identification information.
  • Business Identification information: Such as business name, doing business as (dba) name, postal address, phone number, email address, account name, tax ID, business type or other similar business identification information.
  • Financial Information:  Such as your bank account and routing number, your business account and routing number and your customer’s account and routing number as well as the type of bank account.
  • Transaction information: Such as Payments, transactions, when and where transactions occur, the names of the transacting parties, a description of the transactions, the payment or transfer amounts, billing and shipping information, participant addresses, email, phone number and bank information, and the devices and payment methods used to complete the transactions.
  • Other Information You Provide: Information that you voluntarily provide to us, including your survey responses; participation in contests, promotions, or other forms or devices; suggestions for improvements; referrals; or any other actions performed on the Services. Information that you provide to Wafi when interacting with our customer support team or other team members via phone, email, online form, or other correspondence.

Information we collect from your use of our Services:

  • Internet or other electronic network activity information: Such as Internet activity, including IP address, type of device, operating system, browser, URL data including information about the URL that you came from and the next URL that you visit, device location data and similar data. Inferences about preferences from cookies and site usage, including those used to gauge interest in obtaining Wafi Services.
  • Third party integration information: Personal information stored with third parties that you choose to provide to Wafi, such as information you may have in a third party application that you may choose to utilize through an integration that Wafi has developed with the third party application. By linking your third party accounts, you authorize Wafi to have access to this information and you agree that Wafi may collect and use this information in accordance with this Privacy Policy.
  • Other information that helps us improve our Services: Wafi uses analytics software to allow us to better understand the functionality of the Wafi Services. We may record information such as how often you use the Wafi Services, the events that occur with such use, aggregated usage, and performance data.  We may combine this automatically collected log information with other information we collect about you in order to provide and improve the Wafi Services.
  • Employment Information: Detailed personal information, such as your date of birth or social security number, and protected legal characteristics, such as your membership in a protected class.  We may collect this information if you apply for or accept a job at Wafi, to the extent required by law. Credit information and criminal record information from third party vendors performing pre-employment background checks as authorized by law.

Other information sources

In order to make sure you are using our Services legally, that you are eligible to use certain Services, and protect your data from bad actors, fraudsters and those looking to put your money at risk, we may collect data about you, your business and your customers from companies that help us verify your identity, check your credit history and help us prevent money laundering and fraud.

Over the past twelve months, and on an ongoing basis, Wafi collects your personal information from other sources including:

  • Information Entered by Merchants and Businesses. Any information businesses that offer you services enter in our system about you
  • Identity Verification. Information from third parties and publicly available sources.
  • Credit, Compliance and Fraud. Information about you from third parties in connection with any credit investigation, credit eligibility, identity or account verification process, fraud detection process, or collection procedure, or as may otherwise be required by applicable law. This includes, without limitation, the receipt and exchange of account or credit-related information with any credit reporting agency or credit bureau, where lawful, and any person or corporation with whom you have had, currently have, or may have a financial relationship, including without limitation past, present, and future places of employment, financial institutions, and personal reporting agencies.

How does Wafi use the personal information that it collects?

We use your data to, among other things, process your payments, send you information about your transaction, identify gaps in our services, determine if our Service would work for you, secure your data, fight fraud, follow the law, enforce our agreements, identify new products we can build, offer you promotions, campaigns and market to you.

Over the past twelve months, and on an ongoing basis, Wafi collects your personal information to do the following:

  • Provide the Wafi Services to you.
  • Validate your account
  • Validate your customer’s account 
  • Verify your identity 
  • Verify your customer's identity.
  • Verify your business identity
  • Customize and improve your Wafi experience and Services
  • Notify you about your account activity.
  • Process transactions and collect fees.
  • Provide customer support and resolve disputes.
  • Prevent, identify, and report potentially prohibited, fraudulent, or illegal activities.
  • Notify you about important changes to the Wafi Services and/or Wafi’s terms of service.
  • Provide you with news, offers, and information about the Wafi Services based on your communications preferences.
  • Process your application for Wafi employment in accordance with law.
  • Providing, maintaining, and improving our Services.
  • Developing new products and Services.
  • Improving, personalizing, and facilitating your use of our Services;
  • Measuring, tracking, and analyzing trends and usage in connection with your use or the performance of our Services.
  • Any other purpose that we disclose to you in the course of providing the Wafi Sites, Wafi Services, or Wafi Employment to you.

How does Wafi share my personal information?

With Other Users of our Services with Whom You Interact
  • When you interact with other users through your own use of our Services including sending or receiving money using the Wafi Services, we will share your information with the other party.
  • If your payment to another Wafi user fails, we may provide that user with details of the unsuccessful payment.

With our third party service providers

  • With third party service providers who help us to provide, maintain, and improve our Services, including service providers who access information about you to perform services on our behalf including fraud prevention, identity verification, fee collection services, as well as financial institutions, payment networks, payment card associations, credit bureaus, and other entities that help us provide the Services

With advertising and analytics companies

  • With advertising companies that run advertising campaigns, special offers, or other events or activities on our behalf or on behalf of your Wafi customers, or in connection with our Services.
  • With third party analytics companies that we use to improve the functionality of the Wafi Services, these companies may receive information about your use and interaction with Wafi Services in order to assist Wafi with providing and improving the Wafi Services.

Business Transfers and corporate changes

  • To a subsequent owner, co-owner, or operator of one or more of the Services
  • To a third party if we are involved in a merger, acquisition, financing, acquisition, divestiture, or dissolution or sale of all or a portion of our stock or assets.

When you ask us to

  • Wafi may release information to third parties upon your request. For example, you may authorize a Wafi integrating partner to access your personal and business information.

Compliance with legal or safety laws

  • Wafi may release your information if we believe disclosure is reasonably necessary to comply with any applicable law, legal process, or government request; to investigate or bring legal action against someone who may be violating our rights, our terms and conditions, or the rights of others; or to protect the safety and security of Wafi, our users, or the public.

Aggregated and anonymized information

  • We also may share (within our group of companies or affiliates, or with service providers or other third parties) aggregated and anonymized information that does not specifically identify you or any individual user of our Services.

With Other partner companies
  • With other companies who deliver services on our behalf, including via the use of cookies and similar automated technologies.

Other than as stated in this Privacy Policy, Wafi does not disclose or sell any of your personal information to third parties without your consent. Please note that third parties, such as merchants that you pay and third party websites that you visit, have their own privacy policies. Wafi is not responsible for the policies and practices of such third parties and you are encouraged to review their privacy policies.

Your access and use of the Wafi Services, and submission of this data to us, constitutes your acceptance of this Privacy Policy and consent to the uses set forth in this Privacy Policy.

Does Wafi sell my personal information?

No. Wafi does not sell your personal information.

How does Wafi use cookies and web beacons?

Wafi uses cookies, advertising identifiers and similar technologies on our Service to help us reach you with personalized digital advertising. Cookies and similar technologies give us the ability to learn more about your interests including how you use our Services, what location you are when using our Services and also allows us to remember you when you return to our Service. By using our Services, you agree to our use of Cookies, advertising identifiers and similar technologies. To learn more about how we may use these technologies please read below:

1. What are cookies?

Cookies are small pieces of data sent from a website and stored in your web browser while you are browsing and it allows Wafi to remember you, recall how you engaged with our Platform, and enables us to serve you targeted and personalized ads.

2. What other user tracking technologies are used?

There are other technologies similar to cookies which track your activities online that we may also use. They are:

1. Web beacons which are tiny unique identifiers that are used to track emails and web pages. 

2. Advertising identifiers work like cookies but on mobile devices including phones and tablets. They are used to serve you targeted digital ads.

We may partner with a third party to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on our website and other sites in order to provide you advertising based upon your browsing activities and interests. 

How can I prevent the use of cookies and similar technologies?

To prevent or opt out of cookies and similar technologies on mobile, tablet and on your desktop, please go to the privacy or ads section within your device settings page and change your preferences. This will probably not stop you from receiving ads but it might stop you from receiving personalized advertising.

How do I opt-out of receiving promotional communications from Wafi?

If you prefer not to receive promotional emails from Wafi, click on the unsubscribe link at the bottom of any promotional email that we send you to remove your email address from future promotional email campaigns. If you have difficulty with the unsubscribe process, contact us at privacy@wafi.cash.

You may opt-out of receiving text messages from Wafi by replying STOP. Opting out may affect your ability to use some of our Services. If you decide to opt out, we can still send you non-promotional communications, such as 2FA sign in code that you request.

What security precautions does Wafi take to protect me?

Wafi uses and follows generally accepted industry standards including administrative, technical, and physical safeguards, to protect the data and information you give to us. We make every effort to protect your information from theft, loss, misuse, destruction, alteration, and unauthorized access and other fraudulent activities. Unfortunately no medium or way of securing data across the internet is 100% guaranteed so we cannot guarantee the absolute security of your personal data or other information. Data storage, retention and processing

We may use third-party service providers such as Amazon Web Services, Google Cloud, Google Analytics and more to store and process your information in the United States and other countries.

We retain your Personal Data as long as we are providing the Services to you, your customers or our Users. Even after we stop providing Services directly or indirectly to you, and even if you close your Wafi account or complete a transaction with a Wafi User, we keep your Personal Data in order to comply with our legal and regulatory obligations. We may also keep your Personal Data to assist with our fraud monitoring, detection and prevention activities. We also keep Personal Data to comply with our tax, accounting, and financial reporting obligations, where we are required to retain the data by our contractual commitments to our financial partners, and where data retention is mandated by the payment methods you used. In all cases where we keep data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time as the law, regulations and operational requirements change materially. We will inform you via email or on our Service when we make changes to this Policy in accordance with the law. If you continue to use our Service after a change has been made to this Policy, that will mean that you have read and agreed to this Policy. If you disagree with any part of the updated Policy, you must stop using our Service. We encourage you to check frequently for any updates and see the “Last Updated” section for the last time this Policy was updated.

Data deletion rights

You can ask the business to delete the personal information they have collected from you (subject to exceptions the law provides).

Right of Non-Discrimination

You have the right to not be discriminated against if you exercise these privacy rights. The business cannot discriminate against you, deny, charge different prices for, or provide a different quality of goods or services if you choose to exercise these rights.

How to exercise your rights

To the extent we act as the service provider (for example, when we process payments on behalf of Merchants and Companies), you can exercise your CCPA rights directly with the Merchant(s) and Company(s) you use.

How do I update my information?

If your information changes, you can update it in your account settings by contacting your organization’s Account Manager or by contacting us at support@wafi.cash.

If you wish to close your account or request that we no longer use your information to provide you the Wafi Services, contact us at privacy@wafi.cash and we will respond to you in a reasonable timeframe.  We will retain your information for as long as your account is active or as needed to provide you the Wafi Services, or to the extent required by applicable law or rule.

What about the privacy of children?

Wafi is a general audience Service. Wafi does not knowingly collect any personal information from anyone under the age of 13.

Rights for California Residents

If you are a California resident, you have the right under the California Consumer Privacy Act (“CCPA”) to request disclosure of the specific pieces of personal information that businesses may have collected from you. California residents also have the right to request deletion of personal information that businesses may have collected regarding you. We are generally a service provider of the merchant or company with whom you interact (for example, we’re a service provider to the lender who lend you money and uses Wafi to pay you and get paid back by you).  As a service provider, the Merchant is the “business” under CCPA and you can exercise your CCPA rights directly with your Merchant.

Right to know

You may have the right to request, up to twice in a 12 month period, to see the personal information a Merchant or Wafi has collected about you during the past 12 month period:

  • The types and specific pieces of personal information the business has collected about you.
  • The types of sources from which the business collected the personal information;
  • The business or commercial purpose for which the business collected the personal information.
  • The types of third parties with whom the business shared the personal information.
  • The types of personal information about you that the business disclosed for a business purpose, and the categories of third parties to whom the business disclosed that information for a business purpose.

California law gives you the right to ask if the business discloses your personal information to third parties for their direct marketing purposes. You also have the right to know if the business sells your personal information, and if they do, to opt out of such sale. Wafi does not sell your personal information to third parties.
